These Terms of Use ("Terms") govern your access to and use of the website located at getfieldwork.ai (the "Site"), operated by Fieldwork AI Inc., a Delaware corporation ("Fieldwork", "we", "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms apply to the Site only. Use of the Fieldwork platform and services is governed by a separate agreement between Fieldwork and your organization (an order form, design partner agreement, or Fieldwork's Terms of Service).

1. The Site

The Site provides information about Fieldwork and its products. Content on the Site is provided for general information only. It does not constitute an offer, and product descriptions may relate to capabilities under development.

2. Eligibility

The Site is intended for business users. You must be at least 18 years old to use the Site.

3. Intellectual property

The Site and all content on it - text, graphics, logos, product names, designs, and software - are owned by Fieldwork or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your internal business purposes. No other rights are granted. "Fieldwork" and associated logos are trademarks of Fieldwork AI Inc.; you may not use them without our prior written consent.

4. Acceptable use

You agree not to:

• copy, scrape, crawl, or harvest content or data from the Site by automated means, including for the training of machine-learning models;
• interfere with or disrupt the Site, probe or test its vulnerability, or circumvent any security or access controls;
• use the Site to transmit malware or unlawful, infringing, or misleading material;
• misrepresent your affiliation with any person or organization; or
• frame or mirror the Site, or use it to build a competing product or service.

We may suspend or terminate your access to the Site at any time for any reason.

5. Submissions and feedback

If you submit ideas, suggestions, or feedback about Fieldwork or its products through the Site, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation. Do not submit information you consider confidential; nothing you submit through the Site creates a confidential relationship with Fieldwork.

6. Third-party links

The Site may link to third-party websites. We do not control and are not responsible for their content or practices. Links do not imply endorsement.

7. Privacy

Our collection and use of personal data through the Site is described in our Privacy Policy.

8. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDWORK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE. FIELDWORK'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100). NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

10. Changes

We may update the Site and these Terms at any time. The "Last updated" date above reflects the current version. Continued use of the Site after changes take effect constitutes acceptance.

11. Governing law and venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising out of these Terms or the Site, and you consent to their jurisdiction.
